Welcome to Tribe Odyssey. These Terms of Service ("Terms") govern your use of our website, NFT collection, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
Tribe Odyssey is a collection of unique digital collectibles (NFTs) running on the Ethereum blockchain. The collection consists of 9,400 unique ape NFT characters and 450 Bitcoin Ordinals.
2. Acceptance of Terms
By accessing and using this website, you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using this website's particular services, you shall be subject to any posted guidelines or rules applicable to such services.
3. NFT Ownership and Rights
3.1 Ownership
When you purchase an NFT from Tribe Odyssey, you own the underlying NFT completely. Ownership of the NFT is mediated entirely by the Smart Contract and the Ethereum Network.
3.2 Personal Use
Subject to your continued compliance with these Terms, Tribe Odyssey grants you a worldwide, royalty-free license to use, copy, and display the purchased Art for the purpose of personal, non-commercial use.
3.3 Commercial Use
Subject to your continued compliance with these Terms, Tribe Odyssey grants you an unlimited, worldwide license to use, copy, and display the purchased Art for commercial purposes, provided that such commercial use does not result in earning more than One Hundred Thousand Dollars ($100,000) in revenue each year.
4. Restrictions
You agree that you may not:
- Modify the Art in any way, including, without limitation, the shapes, designs, drawings, attributes, or color schemes
- Use the Art to advertise, market, or sell any product or service not authorized by Tribe Odyssey
- Use the Art in connection with images, videos, or other forms of media that depict hatred, intolerance, violence, cruelty, or anything else that could reasonably be found to constitute hate speech
- Use the Art in movies, videos, or any other forms of media, except to the limited extent that such use is expressly permitted in these Terms
- Sell, distribute, or otherwise commercialize merchandise that includes, contains, or consists of the Art
- Attempt to trademark, copyright, or otherwise acquire additional intellectual property rights in or to the Art
5. Blockchain Technology
You acknowledge and agree that:
- The Ethereum blockchain and Bitcoin network are decentralized networks not under our control
- Transactions on the blockchain are irreversible and cannot be undone
- Gas fees and network congestion may affect transaction timing and costs
- We are not responsible for any losses due to blockchain-related issues
6. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
IN NO EVENT SHALL TRIBE ODYSSEY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
8. Governing Law
These Terms shall be interpreted and governed by the laws of the jurisdiction in which Tribe Odyssey operates, without regard to conflict of law provisions.
